Judge Samuel Alito of the Third Circuit is President Bush's second nominee for the Surpreme Court to fill Justice O'Connor's position. One question senators, the press and the public will debate is where should Judge Alito be placed among the current justices ideologically-speaking. Some say Judge Alito's affectionate (?) nickname, "Scalito," is demonstrative of his ideologicial position; namely, that Judge Alito's judicial philosophy, particularly regarding matters of constitutional interpretation, closely follows Justice Scalia's. It may be unfair to consider someone who has written well over 200 opinions as a federal appeals court judge a clone of a supreme court justice, but the president's rather quick selection of Judge Alito conveys the impression that the president was assured he has high confidence that Judge Alito will not be mired by republicans. It seems certain that Judge Alito is NOT a Justice O'Connor clone; interestingly enough, no one seems confused of that. Observing the Court as it existed last term (the new court seems too unpredictable to judge), I suspect Judge Alito fits ideologically between Rehnquist and Scalia (in cases, for example, where Rehnquist would join Kennedy/O'Connor rather than Scalia or Thomas, Alito will likely join Scalia: see, e.g., U.S. v. Booker (2005))
