Apple blamed for piracy

30 November '05 - 09:10. Category: default

Nick Wingfield, in an article in today's Wall Street Journal (p. b1), explores "how all those iPods [Apple] is selling to the public are really being used." Wingfield offers no clear conclusion, but suggests that those with affections for the recording industry seem convinced that iPod users are "loading up on pirated content from file-sharing services." The article is worth reading because it cleary explains the nuts and bolts of the intersection of innovative technology, new business methods, intellectual property issues, and status quo business practices affected by technological change. I am going to venture into controversial grand-standing: the legal issues in the iPod/file-sharing debate - - which, of course, stretch far beyond the iPod and file-sharing - - seem to have become less about values and principles and increasingly more reflective of the exercise of raw political power (i.e. who gets to dictate what the law will be). Apple has mitigated the influence of raw political power in this debate through innovating a great product and gaining market dominance, but the battle goes on and an open competitve market may not win with courts and congress.

Justice Kennedy quoted recently on judging

07 November '05 - 13:11. Category: default

"...You have the duty of introspection and reflection and study, and of judging, of adjudicating, based on what you hear. I think you have a duty to keep an open mind. That's not indecisiveness. That's just a commitment to the tradition of the law..." - Justice Kennedy

Young Lawyers not slackers

07 November '05 - 09:08. Category: default

Apparently, some lawyers believe that young associates whine too much about work hours, demand big pay for small output, and have no sense of commitment to the harsh realities of life as a large law firm assoicate. Could this be possible? The American Lawyer published an article recently deconstructing the slacker mythology.

"...partners who suggest that their generation worked longer hours are simply delusional..."
